These Terms and Conditions (“Terms”) govern your use of the website at https://lgvfit.com, our mobile application, our physical facility, and our services (collectively, the “Services”) operated by Longevity Total Fitness (“LTF,” “we,” “us,” or “our”), located at 4950 Terminal St Suite 900, Bellaire, Texas 77401. By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.
1. Eligibility
You must be at least eighteen (18) years of age to create an account or enter into a binding membership agreement with us. If you are between thirteen (13) and seventeen (17), you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. Children under thirteen (13) are not permitted to use the Services.
2. Account Registration
To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at longevity@lgvfit.com if you suspect unauthorized access.
3. Membership and Facility Use
3.1 Membership Agreement
Use of our physical facility is governed by a separate Membership Agreement signed at the time of enrollment. The Membership Agreement, including its liability waiver and assumption of risk provisions, is incorporated by reference into these Terms.
3.2 Health and Safety
Exercise carries inherent risks of injury. By using our facility, equipment, classes, or training services, you acknowledge that you are voluntarily participating in physical activity. You should consult with a qualified medical professional before beginning any exercise program, particularly if you have a medical condition or have not exercised regularly. LTF is not a medical provider, and nothing on the Services constitutes medical advice or treatment.
3.3 Code of Conduct
While using our facility, classes, or app community features, you agree to:
- Treat staff, trainers, and other members with respect.
- Follow posted facility rules and trainer instructions.
- Wipe down equipment after use.
- Wear appropriate workout attire and closed-toe athletic shoes.
- Refrain from harassment, discrimination, threatening behavior, or any conduct that disrupts the experience of other members.
- Refrain from using the facility while under the influence of alcohol or non-prescribed controlled substances.
Violation of the Code of Conduct may result in suspension or termination of your membership without refund.
3.4 Photography and Recording
Our facility uses surveillance cameras for the security of members and staff. Members are not permitted to record video or photographs of other members or staff without their express consent. From time to time, LTF may capture photographs or video of classes and the facility for promotional purposes; we will obtain written consent before using any image in which an individual member is identifiable.
4. Mobile Application
4.1 License
Subject to your compliance with these Terms, LTF grants you a limited, non-exclusive, non-transferable, revocable license to download and use the mobile application for your personal, non-commercial use.
4.2 App Store Terms
Your download and use of our application from the Apple App Store or Google Play is also governed by the respective platform terms. In the event of any conflict between these Terms and the applicable platform terms with respect to app distribution, the platform terms will govern as to that distribution.
4.3 In-App Purchases and Subscriptions
Certain features of our app may require payment. All purchases and subscriptions are processed by the applicable app store. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You may manage or cancel subscriptions through your app store account settings. No refunds are provided for partial subscription periods except as required by law or by app store policy.
4.4 Account Deletion
You may delete your app account and associated personal information at any time. See the Privacy Policy section titled Account and Data Deletion for details on how to do so.
5. Personal Training and Coaching
Personal training, nutrition coaching, and body composition analysis services are provided subject to separate scheduling and payment terms communicated at the time of booking. Sessions canceled with less than twenty-four (24) hours notice may be charged in full. Results of training and nutrition coaching depend on individual factors and are not guaranteed.
6. Payments and Refunds
You agree to pay all fees and charges associated with your membership, personal training, or in-app purchases. All payments are non-refundable except as expressly stated in your Membership Agreement, in these Terms, or as required by law. Refund requests for app-related charges should be directed to the applicable app store.
7. Intellectual Property
The Services, including all content, trademarks, logos, software, and design elements, are owned by LTF or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any portion of the Services without our prior written consent.
8. User Content
If you submit photos, comments, testimonials, or other content to our Services, you grant LTF a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute such content in connection with the Services and our marketing, subject to our Privacy Policy. You represent that you have all necessary rights to grant this license and that the content does not violate the rights of any third party.
9. Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, LTF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE ANY SPECIFIC FITNESS, HEALTH, OR BODY COMPOSITION RESULTS. RESULTS DEPEND ON MANY INDIVIDUAL FACTORS, INCLUDING ADHERENCE TO PROGRAMS, GENETICS, NUTRITION, AND MEDICAL HISTORY.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LTF, ITS OWNERS, OFFICERS, EMPLOYEES, TRAINERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO LTF IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless LTF and its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any rights of another party.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas.
13. Dispute Resolution
Before initiating any legal proceeding, you agree to first attempt to resolve any dispute by contacting us at longevity@lgvfit.com and providing a detailed description of the issue. If we cannot resolve the dispute informally within sixty (60) days, either party may pursue available legal remedies subject to these Terms.
14. Modifications
We may update these Terms from time to time. Material changes will be communicated through the Services or by email. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the changes.
15. Termination
We may suspend or terminate your account or access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will survive.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
